1.1 Price calculation online (www.aquariumconfigurator.be)
This calculation module was written, compiled and programmed by the authors with the greatest care. Aqualife does its utmost to keep this module, which is made available to you as a tool, up to date.
However, errors, including those that may be made by the user when entering the parameters, can never be completely ruled out.
Aqualife therefore feels compelled to point out that it does not consider itself bound by the outcome of this module, and that it does not accept any legal responsibility or any other form of liability for consequences based on possible incorrect information or incorrect calculations.
When ordering, we will always contact you if there are any ambiguities to discuss everything.
The Price configurator also has a 3D drawing module, however the finishing colours and drawing lines are for illustration purposes only and may differ from reality.
However, please do not hesitate to report any errors. All users of this module and its authors are grateful to you.
1.2 Sale of goods & Custom aquariums
1. Payment of invoices must be made no later than 30 days after the invoice date. 2. In the event of late payment, a default interest of 1% per month is due on the invoice amount, starting from the due date and without notice of default. 3. In the event of late payment of the invoice, the amount thereof will automatically be increased by a fixed compensation of 10% by operation of law and without notice. Legal costs (e.g. summons costs, legal fees, etc.) are not included, so that these are due to Aqualife nv in addition to the fixed compensation. 4. Any complaints must be reported to us by letter within 5 days after the date of delivery. 5. Only the courts of Neerpelt & Hasselt have jurisdiction for any disputes. 6. The goods are delivered carriage paid from an amount of € 1500.00 incl. VAT. If the amount of your purchase (see receipt) is lower, we are obliged to charge transport or installation costs. Collection is of course free. 7. All prices stated are exclusive of the costs of legally prescribed levies for the return, storage and processing of waste products (excluding disposal contribution: recupel). We cannot be held responsible for price increases set by our suppliers. 8. Aquariums that need to be repaired must be returned clean to our workshop. They must be provided with a proof of purchase with the date of purchase. If the aquarium is not cleaned upon arrival, we are obliged to charge a surcharge. 9. We give a 2-year guarantee against leakage, but not against glass breakage! Make sure that your aquarium is level in all directions. We cannot be held liable for the content (e.g. death of fish, plants, corals, etc.) of the aquariums and accessories. NO WARRANTY can be given on our aquariums if these aquariums are placed on racks of shop installations or bases that were NOT supplied and installed by our company. Tip: also inform your insurance company before installing an aquarium. 10. Retention of title: Aqualife Nv reserves the ownership of delivered and to be delivered goods until the time of full payment of the purchase price, if applicable increased by interest and damages. If Aqualife Nv invokes the retention of title, the agreement concluded in this regard will be deemed to have been dissolved, and Aqualife Nv can come and load the delivered goods itself or have them put in its possession, without prejudice to the right of Aqualife Nv to claim compensation for damage, lost profit and interest. The buyer is obliged to immediately inform Aqualife Nv in writing of the fact that third parties are asserting rights to goods to which a retention of title applies under this article. 11. Limitation of liability: Aqualife Nv performs its duties as may be expected of a company in its industry, but accepts no liability for damage, including consequential damage, resulting from its actions or omissions in the broadest sense of the word, except to the extent that this is attributable to its gross negligence, gross negligence and/or intent, or if otherwise ensues from statutory provisions of mandatory law, in particular with regard to product liability. The same limitation applies as a matter of course with regard to employees and/or third parties that Aqualife Nv uses in the performance of its activities. Aqualife can also not be held liable for consequences resulting from integrated techniques and/or material supplied by third parties. 12. Without prejudice to the provisions in the other paragraphs of this article, the liability of Aqualife Nv - on whatever grounds - is limited to the amount of the net price of the goods delivered or the work performed. Compliance with this provision applies as the sole and full compensation for damages. Without prejudice to the provisions of the previous paragraph of this article, Aqualife Nv shall never be liable for compensation exceeding the insured amount, insofar as the damage is covered by an insurance policy taken out by Aqualife Nv. 13. Regardless of the reimbursement of any costs already incurred, compensation for loss of profit incurred by Aqualife Nv shall be due in the event of unilateral cancellation of a valid agreement by the co-contractor. This compensation for loss of profit shall be set at a flat rate of 30% of the agreed price, unless Aqualife Nv provides proof that the loss of profit represents greater damage.
14. Deviation and tolerance of the delivered materials. Because all our products are custom made, there is a possibility that with glass processing, metal constructions and/or wood processing there can be a deviation of +/- 2 mm on the indicated or ordered dimensions or thickness of materials. These tolerances fall within the standard and cannot be appealed to.
15. Cancellation or refusal of order, with custom work it is not possible to cancel the order afterwards or between the waiting times for all kinds of reasons or circumstances. In case of problems with delivery we try to find a solution those that have occurred or have arisen during production or delivery. The purchase amount can in all cases not simply be refunded to your account. We also ask for your understanding in this.
16. Your rights as a consumer do not stop at the border. If you have a problem with a purchase from us, first try to contact our company yourself. Or use the services of ECC Belgium and its European network free of charge (https://www.eccbelgie.be/)
Delivery
Our products are delivered in Europe. The time of delivery of the products is an obligation of means and will take place, to the extent possible, at the place and time agreed with the customer. Late deliveries due to force majeure, incorrectly provided delivery addresses or unforeseen circumstances depending on the will of AQUALIFE cannot give rise to claims for damages on the part of the customer. If the delay of AQUALIFE is due to the customer (e.g. unforeseen circumstances, incorrectly provided address, not present at the delivery), then the additional costs can be charged by AQUALIFE. Unless otherwise agreed, transport costs and the costs of delivering the goods to the customer are not included in the prices indicated by AQUALIFE. The costs of transport and delivery are stated separately or are clearly stated in the online calculator or via a quote request.
AQUALIFE has the right to make partial deliveries. In case of non-delivery of the goods, any sums paid by the customer will be refunded without interest or other compensation.
Right of withdrawal
The AQUALIFE collection consists of products that are put together based on individual choices. Customers can choose from a wide range of options such as different sizes, different colours and different finishes. The majority of our products are made after the customer's order and to the customer's specifications.
The exercise of the right of withdrawal by the customer is therefore excluded. This applies to all forms of orders (online, telephone and store purchases).

Below you can find an indication of delivery times of our various services and production delivery times.
* Webshop orders that are in stock and for which no delivery date is shown will be delivered to your home within +/- 48h. Please note, for neighboring countries it can sometimes be a day later. For larger and heavier shipments it can sometimes take a little longer because it may be sent with "pallet of heavy goods" shipment.
* Custom aquariums + furniture have a delivery time of 8 - 12 weeks
* Custom aquariums without furniture should take approximately 8 weeks

Complaints
Complaints must be sent by e-mail to info@aqualife-nv.be. In order to be admissible, they must be received within eight (2) days of delivery. In the event of a dispute, the customer must be able to provide proof of receipt of the e-mail. The receipt of the goods by the customer covers any possible defect or non-conformity that could then be established. NB: Any complaints relating to a product that has been modified, treated or edited by the customer himself are inadmissible and will not be processed further.
Cookies
When offering electronic services and/or products, we use cookies. Cookies are small text files that are placed on your computer. The cookies are used to analyze internet behavior (click behavior) of visitors to improve our services and website use.
Tracking cookies
We collect data to gain a better understanding of our customers (website visitors), so that we can tailor our services accordingly. Security and retention periods
Heldere Tekst takes appropriate measures to protect your personal data against misuse. Only necessary persons have access to your personal data, which are protected and controlled. Your personal data are stored and processed by us for a period that is necessary for the purpose of the processing and in function of our relationship with you.
Access, correction and deletion
According to the General Data Protection Regulation (GDPR), you as a data subject/website visitor have a number of rights. These include the right to access, delete, correct, object and complain. You can exercise your rights by contacting us via email or the contact form. If you have a complaint about the way in which we handle privacy, you can always contact us for an adjustment.
Third parties In the event that we use third parties to process personal data, we will enter into a processing agreement with that party. Aqualife will never provide personal data to third parties without your express written consent.
When the Aqualife website refers to another website, this statement is no longer applicable. This privacy statement only applies to the Aqualife website.
In exceptional cases, we may have to release your personal data without your consent, for example if we receive a court order to do so or if we have to comply with mandatory laws or regulations. We will do our utmost to inform you of such situations in advance.
Social media
Our website includes buttons from social media. These work by means of pieces of code that originate from those media themselves. By means of these codes, cookies are placed that can be read by these companies. This is used to recognize the website visitor when he or she is logged in to a social network.
